1. What this service is / 这是什么服务

We host real-estate listings and 3D/VR tours for real-estate agents, and provide tools to capture, edit and share them and to hold live VR showings. Using the site, the PlaceVR app or our WeChat mini-program means you accept these terms. When you create an account you will be asked to confirm that you agree to them.
我们为地产经纪托管房源与 3D/VR 看房,提供采集、编辑、分享的工具,并支持 VR 线上带看。使用本站、PlaceVR App 或我们的微信小程序,即表示接受本条款。注册账号时,我们会请你确认同意本条款。

1a. Our role / 我们的角色

MyListings is a software platform operated by Avantiteam Inc. We are not a real-estate broker or salesperson, we do not represent buyers, sellers, landlords or tenants, and we are not a party to any transaction or agreement between agents and their clients. Listing information, prices, availability and descriptions are provided by the agents who publish them; we do not check them. If you are a buyer, renter or other visitor, the agent who shared a listing with you — not MyListings — is responsible for it and for any advice you receive. Nothing on the service is legal, financial or tax advice.

2. Your account / 你的账号

You are responsible for what happens under your account. Keep your password (or your Apple/Google sign-in) to yourself. Tell us immediately if you think someone else has access.

2a. Eligibility and registration / 资格与注册信息

You must be at least 18 years old and able to enter into a contract to create an account. The information you give us when you register must be accurate, and you must keep it up to date. One person per account: do not share your account or let others sign in as you. If you use the service as an agent, you confirm that any licence status, brokerage name or other professional information you show is true and current.
你须年满 18 岁、具备订立合同的能力,才可以注册账号。注册时提供的信息须真实,并保持更新。一人一号:不得共用账号,也不得让他人以你的身份登录。如果你以经纪身份使用本服务,你确认你展示的执照状态、所属经纪公司名称以及其他职业信息真实、有效。

2b. Privacy / 隐私

Our Privacy Policy (/privacy) explains what we collect, including visitor browsing records and, once you register, the link between your browsing history and your email (Privacy Policy, section 2), who can see visitor records (section 3), which service providers receive data (section 5), and how to delete your data (section 7). It forms part of these terms.

3. Who owns your content / 内容归属

Listing pages and what the service produces belong to us. As between you and us, Avantiteam Inc. owns the listing pages on this service and everything the service itself produces — VR tours and tour data, stitched panoramas, floor-plan renderings, page layouts, share links and share cards, QR codes and AI output — to the extent any rights exist in them. This does not take away the rights that you or anyone else hold in the material you supplied, such as the copyright in a photo; that material is covered by the licence below.

Your licence to us. For everything you upload or submit — photos, panoramas, video, floor plans, listing text, capture data and other content — you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence, which we may sublicense and transfer, to host, copy, adapt, edit, translate, combine with other material, publicly display, distribute and promote it, on this service and elsewhere, including in our own marketing and through our partners, and to take it down, make it not public or delete it. We take a licence, not ownership, of material you upload because you often do not own it yourself — a photo may belong to the photographer or your brokerage, listing data to an MLS, and a person's image to that person — and you cannot give us more than you have. This licence continues after you stop using the service or delete your account, except as section 7 describes.

Our control of listing pages. We may at any time, for any reason and without notice, take down, make not public, edit, re-arrange, label or delete any listing page or any content on it, and share, display, distribute and promote any listing page, on this service and elsewhere. We do not have to keep any listing page online, and we do not have to review content, but we may act on any content we believe breaks these terms or the law, or that we receive a complaint about.
我们对房源页的处置与分享。我们可以随时、出于任何理由、无需事先通知,将任何房源页或其上的任何内容下架、设为不公开、编辑、重新编排、加注标识或删除,并可以在本服务上及其他地方分享、展示、分发与推广任何房源页。我们没有义务让任何房源页保持在线,也没有义务审查内容;但对我们认为违反本条款或法律的内容,或者收到投诉的内容,我们可以采取上述任何措施。

What you confirm. You are responsible for everything you upload, publish or send through the service. You confirm that, for everything you upload, you have the rights and permissions needed to grant the licence above — including from the photographer, from your brokerage, from the property owner (including permission to photograph the property) and from any person who can be identified in it — or, for material from an MLS, that you are allowed to provide it under that MLS's rules (section 4a). If you do not have permission for all of these uses, do not upload it.

Listings that belong to a company account. In these terms and in the Privacy Policy, saying that a listing belongs to, is held in or stays in an account — your own or a company account — describes who manages it on this service; it does not change our ownership and rights under this section. Once a listing has been assigned to a company account, that listing and its content — photos, panoramas, floor plans, listing text, VR tours and capture data, including anything added later — are held in that company account on this service, and the company's active owners can manage it. Each listing has one responsible agent. If your membership in a company ends, every listing in that company account for which you are the responsible agent at that moment leaves the company account together with you and stays in your own account, with its content and its history; the company does not take it over, and it is not handed to another member. When it leaves the company account, such a listing is automatically set to not public; you decide whether to make it public again, subject to our rights above. Listings in the company account for which another member is the responsible agent stay in the company account, including listings you photographed. Deleting your own account is different from leaving: when you delete your account (requests made on or after November 14, 2026 at 7:00 PM New York time), the listings in a company account for which you are the responsible agent are deleted together with your account, and the company's owners are notified (see the Privacy Policy, section 7); for requests made before November 14, 2026 at 7:00 PM New York time, those listings remain in the company account. For content you add to a listing while it is in a company account, you grant the company, and whoever is that listing's responsible agent, a non-exclusive, royalty-free, perpetual licence to keep using, editing and publishing it for that listing. This section does not decide who owns the copyright in photos you took — that is up to the law and to any agreement between you and the company. Listings in your own account that have not been assigned to a company stay in your own account when you join or leave a company. Leaving a company does not remove copies you already have, including capture files saved on your own phone.

3a. Authorization to advertise / 对外广告的授权

For any listing that becomes publicly visible through the service, you confirm that you (or your broker) have obtained the property owner's authorization to advertise it. We do not verify that authorization — it is your responsibility as the licensee. Your authorization must also cover the display and distribution of the listing by us as described in section 3.
对任何通过本服务对外公开的房源,你确认你(或你的挂靠经纪公司)已取得该房产所有权人对外广告的授权。我们不核实该授权 —— 作为持牌人,这是你的责任。该授权须同样涵盖我们按第 3 节对该房源进行的展示与分发。

3b. Credits, payments and refunds / 积分、付款与退款

Some features (such as AI shots) are paid for with prepaid credits. You buy credits in packs on the Credits page in your dashboard; the pack price is shown before you pay, and applicable sales tax is added at checkout. One credit is worth US$0.10 of usage. Payments are one-time: there is no subscription and nothing renews automatically.
部分功能(如 AI 截图)使用预付积分付费。积分在后台「我的积分」页按充值包购买;付款前显示包价,结账时另加适用的销售税。1 积分对应 0.10 美元的用量。付款为一次性:没有订阅,不会自动续费。

Credits belong to the account that bought them. They are not shared with a company or with other members, and they cannot be transferred, sold or exchanged for cash.
积分归购买它的账户所有,不与公司或其他成员共享,不可转让、出售或兑换现金。

Credits do not expire, and no fee is ever charged against your balance.
积分不会过期,我们不会对余额收取任何费用。

All credit purchases are final and non-refundable, except where the law requires otherwise — for example, under New York law you may ask us to pay out in cash a remaining balance worth less than US$5. To make such a request, email info@mylistings.top.

Each feature's price in credits is shown before you use it. We may change these prices; a change applies only to actions started after it takes effect. Credits already deducted, and actions already started, are not affected.
每项功能所需积分会在你使用前显示。我们可能调整单价;调整只对生效后发起的操作适用,已扣除的积分与已发起的操作不受影响。

If a charged action fails, the credits for it are returned to your balance. If you cancel before the request has been sent to our AI provider, the credits are returned; once it has been sent, they are not.
扣分的操作失败时,积分退回余额。在请求发送给 AI 服务商之前取消,积分退回;已发送后取消,不退。

If a payment is refunded or charged back, the credits from that payment are removed from your balance; if your balance is too low, the shortfall is recorded and must be cleared before you can spend credits again.
付款被退款或拒付时,该笔付款对应的积分将从余额中扣回;余额不足的部分记为欠分,清偿前不能使用积分。

If you were on a paid subscription before credits were introduced, it continues on its current terms until the end of the period you have already paid for, and will not renew.
积分上线前已开通付费订阅的用户:按原条件继续到已付费期结束,不会续费。

4. Acceptable use / 使用规范

Do not upload content you have no right to, do not misrepresent properties, do not use the service to harass anyone, and do not try to access other users' data or break the service.
不得上传你无权上传的内容、不得虚假描述房源、不得用于骚扰他人、不得试图访问他人数据或破坏服务。

In particular, you must not: publish listing content that is false or misleading, including images that add, remove or change permanent features of a property; publish content that indicates a preference, limitation or discrimination prohibited by fair-housing laws; advertise a property without the authorization described in section 3a; send messages to people who have not agreed to receive them where the law requires their agreement; record a live showing or its participants where the law requires their consent and you do not have it; scrape, copy in bulk or resell data from the service; probe, overload or bypass the security of the service; or use the service for anything illegal.
具体而言,你不得:发布虚假或误导性的房源内容,包括增加、删除或改变房产永久性特征的图片;发布表达公平住房法律所禁止的偏好、限制或歧视的内容;在未取得第 3a 节所述授权的情况下对外广告房产;在法律要求对方同意的情况下,向未同意接收的人发送消息;在法律要求取得同意而你未取得时,录制线上带看或其参与者;抓取、批量复制或转售本服务的数据;探测、压垮或绕过本服务的安全措施;或将本服务用于任何违法用途。

4a. Listing data and MLS / 房源数据与 MLS

If you publish information that came from a multiple listing service (MLS) or another listing database, you are responsible for following that service's rules and your licence obligations, including rules on who may display it, where, with what attribution and for how long. We do not check whether you are allowed to publish it. The MLS or other owner keeps its rights in that data, and our licence and sharing rights in section 3 apply to such material only as far as that MLS's rules allow.

4b. AI-generated content / AI 生成内容

Some tools generate or change text, images or video with AI. AI output can be wrong. Before you publish it, you must review it and make sure it is accurate and allowed; you are responsible for what you publish. How AI images are labelled is described in the Privacy Policy, section 5.
部分工具会用 AI 生成或改动文字、图片或视频。AI 的输出可能出错。发布之前,你须自行审阅,确认内容准确、合规;你对你发布的内容负责。AI 图片如何标注,见隐私政策第 5 节。

4c. Live showings and share links / 线上带看与分享链接

When you host a live VR showing, you control who you invite; anyone with the invitation can join while it is open. Anyone who has a share link you created can open what it points to until you or we turn it off, or it stops working under the rules shown in the product. Share links only with people you intend to see the content.
你主持 VR 带看时,邀请谁由你决定;带看开放期间,任何持有邀请的人都可以加入。持有你创建的分享链接的任何人,都可以打开链接指向的内容,直到你或我们关闭它,或它按产品中显示的规则失效。请只把分享链接发给你希望看到这些内容的人。

4d. Third-party services / 第三方服务

Parts of the service rely on other companies — for example payment processing, AI processing, real-time audio and video, storage, email, sign-in with Apple, Google or Facebook, and WeChat. Those companies' own terms may also apply to you, and we are not responsible for their services. The current list and what each one receives is in the Privacy Policy, section 5. Links to other websites are provided for convenience; we do not control them.

5. Service availability / 服务可用性

We are a small team. The service is provided "as is", without warranties. We may change or suspend features, and we do our best to keep data safe — but you should keep your own copies of anything critical.

To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted or error-free, or that VR tours, measurements, floor plans or AI output will be accurate.
在法律允许的范围内,我们不作任何默示保证,包括适销性、特定用途适用性与不侵权;我们也不保证服务不中断、无错误,或者 VR、尺寸、户型图、AI 输出准确。

5a. Our rights and your licence to use the service / 我们的权利与给你的使用许可

The service, its software, design and our trademarks belong to us or our licensors. While you follow these terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the service and the PlaceVR app for their intended purpose. You may not copy, modify, reverse-engineer or resell them except where the law allows. If you send us ideas or feedback, we may use them without any obligation to you.
本服务、其软件、设计以及我们的商标归我们或我们的许可方所有。在你遵守本条款的前提下,我们授予你一项个人的、非独占、不可转让、可撤销的许可,按其用途使用本服务与 PlaceVR App。除法律允许的情形外,你不得复制、修改、反向工程或转售它们。你向我们提出的想法或反馈,我们可以使用,且对你不负任何义务。

5b. Copyright complaints / 版权投诉

If you believe content on the service infringes your copyright, email info@mylistings.top with: your contact details; the work you say is infringed; the link to the content; a statement that you believe in good faith the use is not authorized; a statement that your notice is accurate and that you are the owner or authorized to act for the owner; and your signature (a typed full name is enough). We review each complaint and may remove the content. If your content was removed and you believe that was a mistake, reply to us by email with your reasons. We may suspend the accounts of people who repeatedly upload infringing content.

6. Liability / 责任限制

To the extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals, lost commissions or lost data; and (b) our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. This section does not limit liability that cannot be limited by law, including for gross negligence or wilful misconduct.
在法律允许的范围内:(a)我们不对间接、附带、特殊、后果性或惩罚性损失负责,也不对利润、交易、佣金或数据的损失负责;(b)与本服务有关的全部主张,我们的总责任以下列两者中较高者为限:你在主张发生前 12 个月内向我们实际支付的金额,以及 100 美元。本节不限制依法不得限制的责任,包括重大过失或故意不当行为的责任。

6a. Indemnity / 赔偿

You will defend and compensate us for third-party claims, losses and reasonable legal costs arising from your content, your listings and advertising, your messages to others, your breach of these terms, or your violation of law or of someone else's rights.
因你的内容、你的房源与广告、你发给他人的消息、你违反本条款,或者你违反法律或侵犯他人权利而引起的第三方主张、损失以及合理律师费用,由你负责抗辩并赔偿我们。

7. Ending it / 终止

You can stop using the service at any time and ask us to delete your data (see the Privacy Policy). We may suspend an account that breaks these terms. Suspending an account does not remove its credit balance; credits cannot be used while the account is suspended.
你可以随时停止使用并要求删除数据(见隐私政策)。违反本条款的账号,我们可能暂停。暂停账号不会清除其积分余额;账号暂停期间不能使用积分。

When you ask to delete your account (requests made on or after November 14, 2026 at 7:00 PM New York time), your listings, VR tours, videos and share links are taken offline immediately and deleted after 30 days, as described in the Privacy Policy (section 7). When the deletion is complete, we stop using those items, except for copies that remain in backups until they expire and copies that were already shared or distributed before the deletion, which we do not have to recall. For photos you took that are part of listings belonging to someone else, the licence continues so that those listings can still be shown; your name is removed from them.

For account deletion requests made before November 14, 2026 at 7:00 PM New York time: deleting your account does not delete the listings you published or the VR tours and share links you created; the licence you granted us in section 3 to host and display them continues for those items after your account is deleted, so that links you have already sent to clients keep working.

7a. Changes to these terms / 条款的变更

We may update these terms. The date at the top shows the current version; updates apply from that date. If you do not agree to an update, stop using the service and you may delete your account. Changes do not apply to disputes that arose before they took effect.
我们可能更新本条款。页首日期就是现行版本,更新自该日起适用。如果你不同意某次更新,请停止使用本服务,你可以删除账号。变更不适用于生效前已经发生的争议。

7b. Electronic notices / 电子通知

You agree that we may give you notices about your account and these terms electronically, by email to the address on your account or by posting them in the service, and that electronic notices satisfy any requirement that they be in writing. This does not give us permission to send you marketing text messages.

8. Governing law / 适用法律

These terms are governed by the laws of the State of New York, USA. / 本条款适用美国纽约州法律。

8a. Disputes / 争议解决

Before filing a claim, please email info@mylistings.top and give us 30 days to try to resolve it. Any claim relating to these terms or the service must be brought in the state or federal courts located in New York County, New York, and you and we consent to their jurisdiction; either of us may instead bring an individual claim in small claims court if it qualifies.
提起主张前,请先发邮件至 info@mylistings.top,并给我们 30 天时间尝试解决。与本条款或本服务有关的任何主张,须向纽约州纽约县境内的州法院或联邦法院提起,你与我们均同意其管辖;符合条件的个人主张,任何一方也可以改向小额法庭提起。

8b. If you use our iOS app / Apple 用户

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app, including product-liability, legal-compliance, consumer-protection or intellectual-property claims. If the app fails to meet an applicable warranty, you may notify Apple, which may refund the app's purchase price, if any. You confirm you are not in a country under a U.S. embargo and are not on a U.S. list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.

If any part of these terms is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. If the English and Chinese versions differ, the English version controls.
